Supreme Court Eyes Trust Code: Possible Court Rule Modification

On December 15, 2009, the Michigan Supreme Court introduced amendments for Section five entitled "Trust Proceedings" of the Michigan Court Rules.  The proposed rule changes modify the manner and method of service permitting parties to agree to service via e-mail.  The Supreme Court also proposes substantial changes

 to MCR 5.125 and deletes rules 5.306 and 5.503.  MCR 5.306 and MCR 5.503 will be replaced by MCR 5.208.  The Court has also proposed changes to 5.501, 5.801, and 5.802.

 

The Court will consider the proposed changes at its next administrative hearing on January 27, 2010.  At its January 27, 2010 administrative hearing, the Court will decide whether to preliminary adopt the proposed amendments prior to the proposed affective date.  The court is departing from its usual practice so lawyers and judges have the opportunity to become familiar with the changes before the proposed effective date of April 1, 2010.
