House Bill to Ban Marihuana Clubs and Bars

On August 24, 2010, Representative Jones introduced House Bill 6394 that would amend the Public Health Code to add MCL 333.7421 to ban the operation of a marihuana "club" or "bar."

Under the bill, a "marihuana bar" is defined as "a structure on land where an individual is allowed to use marihuana under the Michigan Medical Marihuana Act...if the use of marihuana on the property is conditioned on the payment of a fee."  A "marihuana club" is defined as "an association of individuals with membership restricted to those who pay money or any other thing of value to become members, the purpose of which is to allow more than 1 individual to use marihuana under the Michigan Medical Marihuana Act...at the same time in the same private place."

A person who violates this section would be guilty of a misdemeanor, punishable by imprisonment for not more than 90 days or a fine of not more than $500, or both.  The bill makes exceptions for a hospice, nursing home or "property where marihuana is legally dispensed under the Michigan Medical Marihuana Act."  The Bill has been referred to the House Health Policy Committee.
