Local Regulations & Possible Changes to Michigan's Medical Marijuana Act |

Michigan electors approved the legalization of medical marijuana in November 2008 and more than 10,000 individuals are now licensed to possess up to 2.5 ounces, grow as many as 60 plants, or both. The sale of medical marijuana is likely to raise concerns for local officials; however, the Medical Marijuana Act, codified at MCL 333.26421 et seq, provides little guidance regarding local regulation. A recent Detroit Free Press article describes the actions municipalities are taking to regulate the sale of medical marijuana. Townships, cities and counties will be faced with tough decisions balancing a patient's right to access his or her medicine and the broader municipal concerns such as zoning, planning and community safety. Recently, Senate Republicans introduced bills to amend the Act. Under the proposed legislation, medical marijuana would be reclassified as a schedule 2 controlled substance and would be dispensed exclusively by pharmacists. Hubbard attorney Eric Misterovich attended a Senate Judiciary Committee hearing on the proposed legislation. He notes that supporters of the current law packed the room and strongly opposed the proposed amendments. You can track the bill's progress here. |
